These terms cover buying and owning an OverHead Alpha. They include our shipping, returns and warranty policies as sections 4, 5 and 6. Plain English throughout — if anything here is unclear, ask us before you order.

1Who we are

OverHead Alpha is designed, assembled and sold by OverHead Works, LLC, a limited liability company registered in STATE, with a registered address at REGISTERED ADDRESS. Throughout these terms, "we", "us" and "OverHead" mean OverHead Works, LLC. "You" means the person placing the order.

2What Alpha is, and what it is not

OverHead Alpha is a consumer desk instrument for aviation enthusiasts and pilots. It displays live ADS-B traffic and airport weather over a Wi-Fi connection.

It is not certified equipment. Alpha is not a traffic advisory system, not a collision-avoidance system, and not for navigational use — on the ground or in the air. It is not approved by the FAA or any other aviation authority for any operational purpose. Do not use it to make any decision about the operation of an aircraft. For flying, use your certified equipment and an approved electronic flight bag.

Alpha contains no ADS-B receiver and no antenna. All traffic data arrives over your internet connection from third-party community ground-station networks.
Coverage depends entirely on those volunteer networks. It is excellent across North America and Europe and good over most populated areas elsewhere, but it thins out over oceans, deserts and remote terrain. We make no guarantee that any particular aircraft will appear.
Data is live, not real-time. Positions refresh every five seconds and the upstream networks carry their own latency.

3Orders, pricing and payment

Checkout is handled by Shopify. When you click a buy button on this site you are taken to a Shopify-hosted checkout, where Shopify processes your payment and collects the details needed to fulfil your order. Your card details are handled by Shopify and its payment processors — we never see or store them.

The price of OverHead Alpha is $249 USD. Sales tax is calculated at checkout where applicable. Prices may change at any time, but the price shown at checkout is the price you pay.

An order is an offer to buy. We accept it when we send you a shipping confirmation. If we can't fulfil an order — a pricing error, a stock problem, or a shipping destination we can't serve — we will cancel it and refund you in full.

We build in batches of a few hundred units. If an item is out of stock the site will say so.

4Shipping and delivery

United States. Free standard shipping. Orders placed on a business day before CUTOFF TIME ship within 2 business days. Delivery is typically 3–7 business days after despatch.

International. Shipping is calculated at checkout. You are the importer of record and are responsible for any customs duties, import VAT or handling fees charged by your country. These are not included in the price and we cannot estimate them for you.

Risk of loss passes to you on delivery to the carrier. If a parcel is lost or arrives damaged, tell us within 14 days and we will make it right.

We ship to LIST COUNTRIES OR 'most countries'.

5Returns and refunds

If Alpha doesn't earn its place on your desk, send it back within 30 days of delivery for a full refund of the purchase price.

Email us first and we'll give you a return address and a reference number.
Return it complete — instrument, cable, power supply and packaging — and in a condition that reflects normal inspection and use. We are not looking for a pristine box.
You pay return shipping unless the instrument was faulty or we sent the wrong thing, in which case we cover it.
Refunds go back to the original payment method within 10 business days of us receiving the return. Original shipping charges on international orders are not refunded.

Nothing here limits any statutory right you have under the consumer law of your own country.

6Warranty

We warrant that OverHead Alpha will be free from defects in materials and workmanship for one year from the date of delivery. If it fails in that period we will repair it, replace it, or refund you — our choice — at no cost to you including return shipping.

The warranty does not cover accidental damage, liquid damage, cosmetic wear, damage from a power supply other than a compliant 5 V USB-C source, or any unit that has been opened or modified — though we'd much rather you told us what you did than pretended you didn't.

This warranty is in addition to, and does not affect, your statutory rights.

7The data service

Alpha's traffic and weather features depend on a service we operate, which draws on third-party data sources including adsb.lol (published under the Open Database License 1.0) and the FAA Aviation Weather Center.

We provide this service at no additional charge for the core function, for the working life of the instrument. There is no subscription.
We provide it on a reasonable-efforts basis. It has no uptime guarantee, and upstream networks we don't control may be interrupted or may change their terms.
If we ever have to change how the service is funded, instruments already sold will keep working with their existing feature set.
You may not resell, redistribute or systematically extract the data the instrument receives.

8Software updates

Alpha checks for firmware updates and tells you on screen when one is available, showing the version and what changed. Nothing installs without you choosing to install it. Updates are free.

We may add, change or remove features in an update. We will describe what changed, and we will not remove the core traffic, weather and clock functions from an instrument you already own.

9Limitation of liability

To the maximum extent the law allows, our total liability arising from your purchase or use of Alpha is limited to the amount you paid for it. We are not liable for indirect or consequential loss.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Read this one properly. Because Alpha is explicitly not certified and not for navigational use, we exclude all liability for any decision made in reliance on what it displays. If you are flying, use your certified equipment.

10Changes to these terms

We may update these terms. The version that applies to your order is the version published when you placed it. This page was last updated on EFFECTIVE DATE.

11Governing law

These terms are governed by the laws of STATE, and the courts of STATE / COUNTY have exclusive jurisdiction — except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections of your own country.
